1. Employee Rights Under the Fair Labor Standards Act (FLSA)
Minimum wage: $14.00/hour (Chicago: $15.80/hour for large employers)
Overtime pay: 1.5x the regular hourly rate for hours exceeding 40 per week
Child labor restrictions: Minimum working age and restrictions on hazardous jobs
2. Illinois Minimum Wage & Overtime Law
Minimum wage: $14.00/hour (as of 2024)
Overtime pay required for hours over 40 in a workweek
Tipped employees: Must earn at least the minimum wage when tips are included
3. Illinois Paid Leave for All Workers Act (Effective Jan. 1, 2024)
All employees are entitled to earn at least 40 hours of paid leave per year
Leave can be used for any reason, with prior notice if possible
4. Illinois Wage Payment & Collection Act
Employees must be paid regularly (at least semi-monthly)
Final wages must be paid within the next scheduled payday upon termination
Employers cannot deduct wages without employee authorization
5. Family and Medical Leave Act (FMLA) – Federal
Eligible employees can take up to 12 weeks of unpaid, job-protected leave for:
Birth/adoption of a child
Caring for a family member with a serious health condition
Personal medical conditions
6. Illinois Workers’ Compensation Law
Provides benefits for employees injured on the job
Coverage includes medical expenses, wage replacement, and disability benefits
Report workplace injuries within 45 days
7. Illinois Discrimination & Harassment Protections (Illinois Human Rights Act)
Discrimination based on race, gender, religion, age, disability, or sexual orientation is prohibited
Sexual harassment is strictly prohibited
Report discrimination to the Illinois Department of Human Rights (IDHR)
8. Illinois Employee Sick Leave Act
Allows employees to use personal sick leave benefits to care for family members
Employers must provide reasonable accommodations for employees needing time off
9. Occupational Safety and Health Act (OSHA) – Federal
Employers must maintain a safe workplace free from recognized hazards
Employees have the right to report unsafe conditions without retaliation

10. Illinois Unemployment Insurance Notice
Employees may qualify for unemployment benefits if laid off or terminated

11. Nursing Mothers in the Workplace Act
Employers must provide reasonable break time and private spaces (not restrooms) for nursing mothers to express breast milk
Applies to employers with five or more employees
